The most recent statement released by the FDA on July 17, 2019, states that they are committed to a sound, science-based policy on CBD. Since there is so much public interest in CBD, the FDA needs to take a rigorous scientific approach that ensures the safety of CBD packaging products. We recommend checking periodically on updates released by the FDA. However, these are the current FDA Regulations and CBD Packaging Products :

The FDA on CBD Drug Marketing

If your CBD product is being marketed as a drug, specifically with the intended purpose to have a therapeutic effect, it generally can’t be sold without FDA approval. This is an extensive process that requires clinical studies. The only FDA-approved CBD drug on the market currently is Epidolex.

The FDA on CBD Dietary Supplement Marketing

It is currently illegal to add food to which CBD has been added in interstate commerce. The FDA currently prohibits the marketing of CBD as a dietary supplement.

FDA CBD Testing and Warnings

The FDA does conduct independent tests on CBD products and has discovered discrepancies in the stated cannabinoid content. Another concern raised by the FDA is false claims made by CBD companies. The FDA has issued several warnings to different companies that have made unsupported medical claims.

The packaging for your CBD product must follow the appropriate guidelines to reduce the risk of misbranding and FDA enforcement action. First and foremost, please make sure that your product doesn’t make any health claims. Be sure to include this information, when talking about CBD packaging products:

  • Identity statement: As mentioned before, the FDA prohibits marketing your CBD product as a dietary supplement. Create an appropriate identity statement, like “botanical supplement”.
  • Net quantity statements: Include accurate statements regarding the quantity of content in the measure, weight, or numerical account.
  • Ingredient statement: A list of product ingredients in descending order of predominance.
  • Responsibility statement: Name and location of the manufacturer, distributor, or packer.
  • Nutrition Statement: If you’re including a nutrition statement, make sure it is in the proper format. This is not required for all CBD products, only when applicable.
  • FDA Disclaimer: We recommend adding an FDA disclaimer. These can vary, but make sure to cover all the bases regarding FDA evaluation, how your product isn’t intended to treat or prevent disease, consulting healthcare professionals, as well as children, nursing, and pregnant women warnings.
