Hemp prohibition in the United States in the past made hemp cultivation and transportation illegal. However, the 2018 Farm Bill has cleared up this point of contention, providing more current legislation for hemp as a legal federal commodity. The 2018 Farm Bill has made it possible for licensed hemp farmers to transport their hemp across state lines. While this bill has made it federally legal to transport across state lines, the infrastructure for this system isn’t quite in place yet. Formal regulations regarding this process haven’t been created but the USDA has issued guidelines for the evolving hemp industry.
The 2018 Farm Bill Allows Hemp Transportation
The most recent memo released by the USDA states,” States and Indian tribes also may not prohibit the interstate transportation or shipment of hemp lawfully produced under the 2014 Farm Bill.” The 2014 Farm Bill indicates that hemp can legally be produced with USDA licensing, state or tribal licensing, or a 2014 Farm Bill-sanctioned hemp research pilot program. It is important to note that each state has different hemp legislation and regulations. While they cannot prohibit the transport of hemp produced under the above three categories, we recommend always researching any state you may be transporting to or through prior to your trip. Make sure that all your licensing is up-to-date and that you’re following particular state law.
Understand Hemp Laws vs. Reality
While hemp transportation is legal, there have been cases where state police still confiscate hemp. While federal law always supersedes state law, please be aware that there is still misconception and ignorance revolving around hemp.
